Carly Rae Jepsen and Owl City are getting sued for alleged copyright infringement in their summer collab, “Good Time.”

Alabama pop-rock singer and songwriter Allyson Nichole Burnett (a.k.a Ally “Cupcake” Burnett) filed the suit in California federal court, claiming that Jepsen, Owl City’s Adam Young, and writers Matt Thiessen and Brian Lee, copied a “unique vocal motif” from her 2010 song, “Ah, It’s a Love Song,” Billboard reports.

She’s referring to the “woah-oh-oh-oh” hook that is prominent throughout “Good Time,” a song that peaked at No. 8 on the Billboard Hot 100 chart.

Burnett, whose music has been featured on MTV’s The Hills and Friendzone, also cites “emotional and psychological damage” from fans asking her why she copied the popular tune.

“Many consumers may incorrectly assume that Burnett copied her own Original Motif from the Infringing Songwriters due to the widespread popularity and publication of ‘Good Time,'” reads the claim. “Burnett’s reputation as an independent artist will be significantly damaged by such incorrect assumptions.”

Burnett is seeking a “constructive trust over all profits and royalties collected.”

Jepsen released her second studio album, Kiss, last month, while Owl City dropped its fourth album, Midsummer Station, in August.
